Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Card Gallery ("Card Gallery," "we," "us," or "our") and govern your access to and use of the Card Gallery mobile application, websites, and related services (together, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian.

2. The Service

Card Gallery lets collectors catalog, display, cast to a TV, and share graded trading card collections. We may add, change, or discontinue features at any time, and the Service may depend on third‑party platforms and data that are outside our control.

3. Your Account

You agree to provide accurate account information and to keep it up to date.
You are responsible for safeguarding your login credentials and for all activity under your account.
Notify us promptly at support@cardgallery.io if you suspect unauthorized use.

4. Subscriptions, Billing & Free Trials

Certain features require a paid Card Gallery membership, offered as an auto‑renewable subscription through the Apple App Store.
Payment, billing, and renewal are handled by Apple through your App Store account. Your subscription automatically renews unless you cancel at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends.
You can manage or cancel your subscription anytime in your App Store account settings. Deleting the app does not cancel your subscription.
If a free trial is offered, it automatically converts to a paid subscription unless you cancel before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
Prices may change. Where required, we will give you advance notice, and changes apply to subsequent billing periods.
Refunds are handled by Apple under the App Store terms; we generally cannot grant refunds directly.

5. Your Content & License to Us

"Your Content" means the images, certification numbers, card details, notes, values, and the names of collections, frames, and showcases you add to the Service. You keep ownership of Your Content.

You grant Card Gallery a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, resize, reformat, and display Your Content solely to operate and provide the Service — including displaying it in the app, rendering it on TVs you cast to, and rendering the public showcase pages you choose to publish. You represent and warrant that you have the rights necessary to Your Content and that it does not infringe or violate anyone else's rights.

6. Public Showcases & Sharing

Public sharing is off by default and controlled by you. When you publish a showcase or create a share link, the cards and details you include become viewable by anyone who has the link until you unpublish it. Do not publish content you do not have the right to share.

7. Acceptable Use

You agree not to:

violate any law or infringe anyone's intellectual‑property, privacy, or other rights;
upload malicious code or interfere with or disrupt the Service;
reverse engineer, scrape, or attempt to gain unauthorized access to the Service, except to the extent this restriction is prohibited by applicable law;
resell, sublicense, or commercially exploit the Service without our permission; or
upload content that is unlawful, infringing, deceptive, or harmful.

8. Card Values, Data & No Financial Advice

The Service displays estimated market values, population figures, player and team statistics, AI‑generated card descriptions, and other information drawn from third‑party sources and automated tools.

This information is provided for general informational and entertainment purposes only. It may be inaccurate, incomplete, or out of date, and it is not an appraisal or valuation and not financial, investment, tax, or insurance advice. We do not guarantee the accuracy of any value, statistic, or description, and you should not rely on it to buy, sell, insure, or value any card. Any decisions you make based on this information are your own responsibility.

9. Third‑Party Services

The Service integrates third‑party platforms and data providers (for example, grading and population data, market and pricing data, sports statistics, cloud infrastructure, and Apple). We do not control and are not responsible for third‑party services or their content, and your use of them may be subject to their own terms and privacy policies.

10. Intellectual Property

The Service — including its software, design, graphics, and the "Card Gallery" and "CardCast™" names and logos — is owned by us or our licensors and is protected by intellectual‑property laws. Subject to these Terms and the App Store Usage Rules, we grant you a limited, personal, non‑transferable, non‑exclusive license to use the app. We reserve all rights not expressly granted.

11. Copyright & DMCA

We respect intellectual‑property rights. If you believe content on the Service infringes your copyright, send a notice to support@cardgallery.io including: identification of the copyrighted work; identification and location of the allegedly infringing material; your contact information; a statement that you have a good‑faith belief the use is not authorized; a statement, under penalty of perjury, that the information is accurate and that you are authorized to act; and your physical or electronic signature. We may remove infringing content and terminate the accounts of repeat infringers.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE, OR THAT ANY VALUES, STATISTICS, OR OTHER DATA WILL BE ACCURATE OR COMPLETE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARD GALLERY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify and hold harmless Card Gallery and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third‑party right.

15. Termination

You may stop using the Service at any time and may delete your account directly in the app under Settings → Delete account. We may suspend or terminate your access if you violate these Terms or for operational, security, or legal reasons. Provisions that by their nature should survive termination (including Sections 5, 8, 10, and 12–14) will survive.

16. Changes to the Service & These Terms

We may modify the Service or these Terms. When we make material changes, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of North Carolina and applicable United States federal law, without regard to conflict‑of‑laws principles. To the extent a dispute is not brought in small‑claims court, you and Card Gallery agree to the exclusive jurisdiction of the state and federal courts located in North Carolina. Nothing in this section limits any mandatory consumer‑protection rights available to you under the laws of your place of residence.

18. Apple App Store — Additional Terms

The following applies to your use of the app obtained through the Apple App Store:

These Terms are between you and Card Gallery only, and not with Apple. Apple is not responsible for the app or its content.
Your license to use the app is a limited, non‑transferable license to use it on any Apple‑branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
Apple has no obligation to provide maintenance or support for the app; that responsibility is ours.
To the maximum extent permitted by law, Apple has no warranty obligation for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation.
Card Gallery, not Apple, is responsible for addressing any claims relating to the app or your use of it, including product‑liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer‑protection or similar law.
Card Gallery, not Apple, is responsible for investigating and resolving any third‑party claim that the app or your use of it infringes that party's intellectual‑property rights.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist‑supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third‑party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

19. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Card Gallery regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
